Special terms and conditions
Please read the following terms and conditions carefully. These Terms and Conditions govern the relationship between you and Offside Travel doing business as Offside Travel AB (hereinafter referred to as: "We", "the Company" or "Offside Travel"). By booking a trip, you agree to be bound by these Terms and Conditions, which outline, among other things, our cancellation policy and certain limitations of liability. These Terms and Conditions affect your rights and designate the governing law and forum for the resolution of any and all disputes.
Offside Travel abides the "Swedish Act on Package Tours" and the "Swedish Travel Guarantees Act". The Travel Guarantee Act means that as our customer you have a money back guarantee if Offside Travel should go into bankruptcy and consequently, a tour, which you have booked and paid for, is cancelled. For more information please visit the Swedish Legal, Financial and Administrative Services Agency's website www.kammarkollegiet.se. The general and the special "terms and conditions" will regulate the agreement between Offside Travel and the Client. If the general and the special "terms and conditions" are contradictory to each other the special "terms and conditions" will be effective. Below you can find Offside Travel's special terms and conditions. Please also read the Consumer Policy Agreements (Swedish Act on Package Tours), you can find them above in the square "Additional information".
Address
The client is solely responsible for making sure that Offside Travel has their accurate address and e-mail address. All correspondence is made via e-mail. If the Client fails to give Offside Travel their correct e-mail address, Offside Travel cannot be held responsible for any cost or inconvenience that this may cause the Client.
Booking and Client details
You can book your tour on the Offside Travel website www.offsidetravel.com, or by e-mail booking@offsidetravel.com. To be able to handle your booking you have to send us information about the Client's: name, address, date of birth, phone number, passport number and nationality. Confirmation
When you have booked your tour, we will confirm your booking by e-mail within 3 working days. If you have not heard back from us within this time, please contact us immediately on booking@offsidetravel.com.
How to pay
All payments shall be made directly to the bank account of Offside Travel. Payment instructions are indicated on the confirmation. All confirmations will be sent via e-mail. Please make sure that you have specified the name/s of the persons travelling and which tour the payment refers to.
Deposit
Within seven days of receiving the confirmation of your booking, you are required to pay a deposit of 170 EUR. Payment instructions are indicated on the confirmation.
Final Payment
The final payment is due 21 days before departure. An invoice will be sent to you 60 days before departure. If you make a booking later than 60 days before departure, you will get an invoice together with your confirmation. If your booking is made 30 days or less before departure, the full amount must be paid at the time you receive your confirmation.
Prices and surcharges
The prices indicated on the website are valid until 2008-12-31. Offside Travel reserves the right to impose surcharges (price increases) due to unfavourable changes in exchange rates, increases in air fares or other transportation costs, increases in local operator costs, taxes, or if government action should require us to do so. If any surcharge results in an increase of more than 5% of the tour cost the Client may cancel the booking within 7 days of notification of the surcharge and obtain a full refund.
Cancellation by the Client
Any cancellation by a Client must be made by e-mail and acknowledged by Offside Travel. The date on which the e-mail is received by Offside Travel or its Agents will determine the cancellation charge applicable. The e-mail is to be sent to booking@offsidetravel.com with the headline cancellation. The cancellation must contain the name(s) and address of the Client(s) and if there is any, a reference number, and which tour will be cancelled.
- If a cancellation occurs earlier then 60 days before departure, the Client will receive
a full refund of their deposit, which is subject to a Cancellation fee of 60 EUR. - If a cancellation is made 60-21 days before departure the deposit is not refundable.
- If the Client cancels the trip within 21-1 days prior to departure, the client will receive
50% refund of the total payment made. - If the cancellation occurs within 24 hours of departure the Client shall pay
the full price of the trip.
Transfer to another departure
If the Client wishes to transfer to another departure date more then 60 days before the departure date of the booked trip, an administrative fee of 25 EUR is to be paid. If the Client wishes to transfer to another departure date, 60 days or less before the original departure date, the same conditions as for cancellation(s) of the tour is effective.
Transfer of name
If you are prevented from travelling on the tour that you booked due to circumstances such as those which would permit you to make a claim on a standard cancellation insurance policy, you may transfer your booking to another person, provided they meet all the requirements relating to that tour. More than 60 days before departure, an administrative fee of 25 EUR will apply. Within 60 days, name transfers are usually not permitted.
Travel Documents and Recommendations
The Client accepts full responsibility for obtaining all necessary documents such as visas, passports, insurance etc. for travelling to the destination(s) described on our website. The Client is solely responsible for any adverse consequences resulting from missing or defective documentation. Any information or advice given by Offside Travel regarding visas, vaccinations, climate, clothing, baggage, special equipment, etc. is purely advisory, provided as a courtesy to the client, and Offside Travel is not responsible for any errors as to the information provided. Offside Travel is not liable for extra costs incurred by clients who fail to hold the necessary documentation. If Offside Travel is fined as a result of you holding incorrect documents, we will ask you to pay this amount. Citizenship documentation requirements and airline-required information vary by destination/carrier and are subject to change without notice; Offside Travel assumes no responsibility for such changes.
Insurance
Clients travelling with Offside Travel are required to have travel insurance valid for the duration of the whole trip. The insurance must include adequate cover for accident insurance, baggage, medical expenses and the cost of repatriation should you become too ill to continue, including helicopter rescue and air ambulance services. It is strongly recommended the coverage be extended to include cancellation, curtailment, loss of belongings and all other expenses, which might arise as a result of loss, damage, injury, delay or inconvenience occurring to the Client. The Client acknowledges that the cost of the tour does not include insurance, and that the Client is required to obtain separate coverage at an additional cost. When obtaining travel insurance the Client must ensure the insurer is aware of the type of travel to be undertaken. (If you commence on a trip without adequate insurance, you may not be allowed to continue on the trip, and you will have no right of refund.)
Cancellation due to minimum number of travellers
Offside Travel reserves the right to cancel any trip if minimum numbers of travellers for a trip is not achieved. If a trip is cancelled the Client will be informed at least 21 days before departure. Minimum number of travellers is indicated in the trip dossier.
Cancellation due to Force Majeur
Offside Travel follows the travel advice given by the Swedish Ministry of Foreign Affairs. Offside Travel reserves the right to cancel any trip, including a guaranteed trip, at any time prior to departure due to terrorism, natural disasters, political instability or other external events which makes it impossible for Offside Travel to operate according to planned schedule. If Offside Travel cancels a tour on which you are holding a full-paid booking you may choose between an alternative trip or a full refund. Offside Travel is not responsible for any incidental expenses that you may have suffered as a result of your booking such as visas, vaccinations, non-refundable flights or loss of enjoyment, etc. If the alternative trip chosen is of a lower value than that originally booked then you are entitled to a refund of the price difference. If the alternative tour you have chosen is of a higher value, then the originally booked tour, you will pay the difference in price.
Force Majeur
Offside Travel shall not be liable in any way to the Client or his heirs, for death, bodily injury, illness, damage, delay or other loss or detriment to person or property or for Offside Travels failure to commence, perform and/or complete any duty owed to the Client if such death, delay, bodily injury (including emotional distress or injury), illness, damage or other loss or detriment to person or property is caused by Act of God, war or war like operations, terrorist activities, civil commotion, labour difficulties, whether or not Offside Travel is a party thereto, interference by authorities, political disturbance, howsoever and where so ever any of the same may arise or be caused, riot, insurrection and government restraint, fire, or any other cause whatsoever beyond the reasonable control of Offside Travel.
Risk
I acknowledge that the nature of the tour is adventurous and may involve a significant amount of personal risk and potential exposure to injury and possibly death. I also recognise and acknowledge that risk and dangers may arise from foreseeable and unforeseeable causes, including weather and other acts of nature or God. I confirm that I am physically and mentally capable of participating in the activity and that I will be mature and responsible in my behaviour and particularly in connection with any drug or alcohol use in which I may participate. I specifically acknowledge and recognise the potential for injury and death, which can result from my irresponsible and immature use of alcohol and/or illegal drugs in connection with or during this trip. I hereby assume all such risk and do hereby release Offside Travel from all claims and causes of action arising from any damages or injuries or death resulting from these inherent risks.
Local Conditions
I acknowledge that I will be visiting places where the political, cultural and geographical attributes present certain risks, dangers and physical challenges greater than those present in our daily lives. By booking travel with Offside Travel, I acknowledge that I have considered the potential risks, dangers and challenges, and expressly assume the risks, which are inherent in such travel conditions. I am solely responsible for acquainting myself with the customs, weather conditions, physical challenges and laws in effect at each stop along the itinerary.
Itineraries
The Client appreciates and acknowledges that the nature of this type of travel requires considerable flexibility and should allow for alternatives. Please understand that routes, schedules, itineraries, amenities and mode of transport may be subject to change without prior notice due to local circumstances or events such as local political conditions, flight cancellations, mechanical breakdown, acts of God, weather, border restrictions, sickness, or other unforeseeable circumstances. By booking a tour with Offside Travel you accept this flexibility, and acknowledge that delays and alterations and their results, such as inconvenience, discomfort, or disappointment, are possible. No refunds will be given for services not utilised.

If you leave the tour
If you are unable, or choose not to, complete an itinerary planned for the trip you booked, Offside Travel shall not be required to supply alternative itineraries, excursions, accommodations, services or staff for any period of time.
The length of the tour
The length of the tour is shown in the trip dossier.
If you are late
If you are late and/or you miss the departure of the trip, you can try to catch up with us. Please note that this will be at your own expenses.
Age Requirements
Many of our tours are not suitable for children. Many times it is demanding to meet a new culture and there might not be the same standard of living as back home. If you are under 18-years-old and would like to travel with us, please inquire with us before you make your booking so that we can tell you more about the tour. Offside Travel reserves the right to deny minors to travel with us.
Medical and health
Many of our tours demand that you have a good physical- and physiological condition. Unfortunately our tours are not suitable for persons with functional disability/impairment. If you have had previous health problems (physiological or physical) we strongly recommend you to consult your physician before joining one of our tours. Please read though the section/part Travelling with us where there you can read more about the physical demands.
Local rules and laws, your responsibility
During the duration of the trip the client is obliged to follow local rules and laws. The client is obliged to show good manners and respect to the people we meet during the trip and to fellow travellers. The decision of the company's tour leader or representative will be final on all matters. By booking with us the client agrees to abide by the authority of the tour leader. If your behaviour, or the behaviour of any member of your party, during any time of your holiday (including all transport) is considered, by the tour leader, to likely cause distress, danger or annoyance to any other customers, property or any third party by any person in a position of authority (such as a drivers or hotel manager) we reserve the right to immediately terminate your holiday. In such a situation we will not be liable to pay any compensation, refunds or costs incurred. In the interests of the comfort and safety of our customers, we also reserve the right to refuse to accept future bookings from any customer who, in our opinion, has behaved in an unacceptable matter on a previous trip.
Special Requests
If you have any special requests at the time of the booking, we will do our utmost to honour that special request. If you make a special request we will pass this on to our supplier but we cannot guarantee anything. If we cannot meet your special request we will not pay any compensation.
Luggage
During the trip Offside Travel is not responsible for any loss or damage to any luggage or personal belongings belonging to the Client.
Documents sent to the Client from Offside Travel
The Client is solely responsible for ensuring that itineraries and other material sent to the Client from Offside Travel are correct. If something is missing the client must notify Offside Travel immediately. For the client to be able to make claims on special requests etc. the special requests must be noted in the confirmations sent to the Client from Offside Travel. If the Client has not received the itineraries for the booked tour the Client must contact Offside Travel no less than 30 days prior to departure. If the client fails to do so, Offside Travel cannot be held responsible for any costs or inconvenience that this may cause the client. If you made a late booking all itineraries will be sent with the confirmation and invoice.
Privacy Policy
To be able to administer travel and hotel bookings for our clients, we will need to forward personal information to local suppliers. This is an administrative necessity for making the tours possible. Offside Travel shall never pass on or sell client information sell client information to a third party.
Claims and Complaints
If a client has a complaint against the company the client must first inform the tour leader or company representative whilst on the tour in order that the leader/representative can attempt to rectify the matter. However, if the client's complaint is not settled to the clients' satisfaction, forward a written complaint in writing to Offside Travel within 2 months of the end of the tour. The company will not accept any liability for claims received after this period. Claims and Complaints should be e-mailed to info@offsidetravel.com, use the headline Complaint.
Applicable law and choice of forum
The laws of Sweden shall govern this Agreement. Each party hereto irrevocably submits to the exclusive jurisdiction of the Allmänna reklamationsnämnden (the Swedish National Board for Consumer Complaints) or a public court in Sweden, in respect of any action or proceeding relating in any way to this agreement.
Errors and Omissions
Although Offside Travel has made a concerted attempt to verify the accuracy of statements made herein the company cannot be held responsible for any error, omission or unintentional misrepresentation that may appear on our website.
Acknowledgement
I have carefully read and understood these Terms and Conditions above. By booking a trip with Offside Travel, I agree to be bound by these Special Terms and Conditions.
